A new law in France has made it illegal to film any acts of violence and post the offending images or videos online. Attempts to document violence now have fines of nearly $100,000 and the possibility of spending up to 5 years in prison.

The law claims to be in response to ‘happy-slapping’, a phenomenon where young people film their friends committing acts of assault and then circulate the videos using mobile phones and the Internet.

• ‘Happy slapping’ is a physical attack on a person carried out with the aim of obtaining a video recording of the attack, which is then circulated by mobile phone or posted on the Internet.

Critics maintain that the new law focuses more on protecting the police in cases of police brutality rather than on the safety of citizens. Film shots of the clashes between police and protestors in the 2005 riots in the suburbs of Paris were broadcasted to the world; raising awareness of police brutality. Now, broadcasting such violent images are punishable by law.

Reporters Without Borders voiced concern today about a new French law on the prevention of criminality following its approval by the constitutional council on 5 March. “The sections of this law supposedly dealing with ‘happy slapping’ in fact have a much broader scope, and posting videos online showing violence against people could now be banned, even if it were the police who were carrying out the violence,” the organisation said.

“It is particularly regrettable that the law would forbid the online distribution of images showing acts of violence by the security forces,” the press freedom organisation added.

Reporters Without Borders thinks it would be shocking if this kind of activity, which constitutes a safeguard against abuses of authority, were to be criminalized in a democratic country.
